Ownership & Responsibility – Ownership transfers to the purchaser at the fall of the gavel, along with all risks and liabilities.
Final Sales & Payment – All sales are final. Payment must be completed by auction end via approved methods (no credit cards for vehicle purchases). Non-payment results in penalties, including liability for resale losses.
Bidding Process – Bidders must register, use assigned numbers, and follow auctioneer decisions, which are final in disputes. The auctioneer may bid on behalf of consignors up to the reserve price but never beyond.
“As Is, Where Is” Policy – All items are sold without guarantees. Buyers are responsible for inspections before bidding. Vehicle history reports are provided when available but not guaranteed.
Liabilities & Removal – WEAA is not responsible for lost, stolen, or damaged property. Buyers must remove purchases within 48 hours or incur storage fees.
Legal Compliance – Transactions follow Indiana laws. Defaulting buyers are subject to legal action, including resale of items and liability for associated costs.
Taxes & Fees – Buyers must pay sales tax where applicable, plus auction fees, including a premium added to the final hammer price.

ONLINE & PHONE BIDDING
Same Rules Apply – Online/phone bidders must follow all standard auction rules in addition to these specific terms.
Registration & Fees – Online/phone bidders must complete registration at least 48 hours before the sale. A $50 internet fee applies to each completed online transaction.
Technology Risks – WEAA is not liable for service interruptions, transmission failures, or cybersecurity issues related to online bidding.
Communication Responsibility – WEAA will attempt to contact phone bidders at provided numbers. If unreachable, no bid will be placed, and the bidder forfeits their opportunity.
Transportation & Storage – Buyers must arrange vehicle transport. WEAA can recommend transport services, but late pickups may incur storage fees.
No Unregistered Bidders – Bids will not be accepted from unregistered users.

CONSIGNMENT
Entry & Sale Position – Sale position is assigned on a first-come, first-serve basis. Changes after the deadline may incur a $100 fee.
Entry Fees & Cancellations – All entry fees are non-refundable. If a consigned vehicle does not arrive, the seller forfeits the fee.
Insurance & Liability – WEAA does not provide insurance or assume liability for loss, theft, or damage. Sellers must maintain their own insurance.
Post-Auction Bidding – Vehicles that do not meet the reserve may remain available for further bidding after leaving the auction block.
No Unauthorized Sales – Selling vehicles on auction property without WEAA’s authorization is prohibited and may result in revoked privileges.
